Terms and Conditions

  • All cancelled lessons must be paid for if not cancelled within 48 hours of their scheduled time and date. Please bring a note pad and pen and eye glasses if worn.

There is a test day pre test 1 hour lesson,  car hire, insurance and return journey to original pick up point.

  • Payment must be made 48 hours prior to the lesson to avoid disappointment.
  • Mobile phones should be switched off during the lesson.
  • Only footwear supporting the heal of the foot (NO FLIPFLOPS) should be worn.
  • Pre paid lesson packages are non refundable and non transferable and must be taken within 6 months from the date of

In these terms and conditions (the “Conditions”) “We”, “Us” Our or “School”, “The instructor”means All Class Driving Academy and Acdal.co.uk

You must read these Conditions in full as they set out the complete terms upon which We have agreed to provide and You have agreed to obtain driving lesson tuition from Us.

We and Your Driving Instructor reserve the right to charge for any lessons affected by Your failure to comply with any of these Conditions.

Lesson/Tuition is only available to persons who meet the following criteria:

Pupil must be aged 17 or over (or aged 16 if in receipt of the higher rate element of the disability living allowance or recently renamed PIP Personel Independence Payment and

Who hold a valid UK provisional driving licence (“Licence”) and

Who are legally entitled to drive in the UK.

Your responsibilities:

It is Your responsibility to ensure that You have the appropriate Licence and the Licence must be presented to Your Driving Instructor prior to the commencement of Your first lesson.

Your Instructor reserves the right to refuse to provide You with lesson tuition or to cancel any lessons You have agreed to or booked, without liability, if You fail to provide him/her with the Licence prior to Your first lesson.

Your lesson tuition is governed by a contract between You and Your Instructor. Accordingly, You and Your Instructor are responsible for arranging the date, time, pick-up location and duration of Your lessons.

You will treat Your Instructor with respect and follow Your Instructor’s reasonable instructions, particularly with regard to matters affecting Your health and safety or the health and safety of others.

Your Driving Instructor’s responsibility:

Provide You with lesson tuition at the hourly rate communicated to You from time to time;

Recommend what are, in their opinion, the most appropriate training methods and aids to help You study for Your theory and hazard perception test;

Design a course of lessons to match Your specific driving and learning needs from Your first lesson right through to Your practical test;

Provide You with lessons which will last 2 hours in duration or such other duration as You and Your Instructor will agree in advance;

Provide a presentable, modern, properly maintained and dual controlled car for your driving lessons.

Recommend, where appropriate, advanced courses to help You develop Your skills for; motorway driving, driving in extreme weather conditions and Pass Plus;

Give You relevant feedback during Your lesson and record Your development in Your ALL CLASS DRIVING ACADEMY training record at the end of each lesson;

Monitor Your progress, advise and recommend what is, in their opinion, the appropriate time to book Your mock practical test and once it has been agreed between you both, apply for Your practical driving test and where required, they will advise whether it should be subsequently rescheduled;

Normally provide training on a one-to-one basis with on rare occasions when agreed by both the instructor and the pupil one other learner in the car;

  • MOBILE PHONES:

Mobile phone to be switched off or put on silent by both the pupil and the instructor during the lesson/s unless an emergency contact for family member needs must.

This will be agreed between the instructor and Pupil prior to any lesson commencing.

DRIVING TESTS:

Where a driving test is cancelled by the DVSA at short notice (test day) for whatever reason. The pupil must pay the schools fixed test day pre test lesson, insurance and car hire charge in full to the school or instructor as per usual. The pupil will then make a claim to the DVSA for their out of pocket expenses.

At the discretion of the instructor he/she can still give driving tuition to the test candidate for up to two hours in such circumstances to reduce the financial impact. Test day car hire and pre test lesson should be paid to the school 7 days prior to the test date. Payment can be made by in-car payment chip and pin terminal, cash, PayPal or Bank Transfer.

  • The school can’t be responsible for Mechanical breakdown. The school will endeavour to provide a replacement vehicle as soon as possible
  • All instructors abide by an equal opportunities policy & herby does not discriminate by race, creed, gender or sexual orientation.
  • The school/instructor and the pupil both reserve the right to mutually agree to terminate lessons at any stage during the physical or verbal contract period.

The school/instructor must be paid in full for the agreed lesson up to 48 hour prior to any lesson commencement.

The school/instructor must be informed at least 2 working days ( excluding Saturdays, Sundays and Bank Holidays) minimum period in advance for any lesson cancellation by the pupil. Less than the 2 working days notice being given for a cancellation will see the pupil losing his/her lesson fee.

ABUSE:

The instructor will not be verbally or Physically abused by the pupil. Nor will the Instructor Verbally or physically abuse the pupil.

Lessons would immediately be stopped and all fees for that lesson and any subsequent lessons where they were to be delivered within a 48 hour period will be charged in the event where the instructor feels threatened. Any additional monies holding on the pupils lesson account will be forfeited. In the case of physical abuse it’ll be absolutely necessary for the appropriate authorities to be informed.

PHYSICAL CONTACT: Physical contact between the instructor and pupil will be avoided unless in an emergency or with consent from the pupil if used for demonstration purposes.

REFUND POLICY:

Where a pupil stops having lessons funds are held by the school for lessons forms period of 6’months. The pupil is entitled to a full refund where a 4 hours or fewer are pre-paid and where a lesson is booked in for the pupil less than 48 hours away than the request for a refund, the next lesson in fully chargeable by the school.

Where possible the school will give the pupil at least 48 hours notice period for any lesson cancellation. Where the time frame falls less than 48 hours the school will compensate the pupil with a 1 hour free of charge lesson.

Where an Instructor for any reason cannot complete a lesson through no fault of the pupils. The school/instructor will make up the time difference on an agreed subsequent lesson.

The school has the right to refuse the use of the car for Driving Test if the school deems the candidate unfit or not ready for sitting and passing the said Driving Test. Where possible the school will make every endeavour to advise and inform the pupil of such decisions within 3 working days (Saturdays, Sundays and Bank Holidays are not deemed working days) of the impending Driving Test date. Where a pupil has joined the school with less than the required 3 working days, and the instructor assessment finds the candidate not ready. The school had no recourse to offer compensation.

The pupil should never drive under the influence of Alcohol or drugs whether prescription or recreational or over the counter medicines which can make the pupil drowsy, inattentive or impaired reactions. If in the event of a ‘Road Traffic Incident’ where it is found the pupil is under the influence of aforementioned substances. Any insurance for both the instructor, pupil and third parties could be deemed null and void, and legal charges could be brought against the school and the pupil.

In the event that the instructor deems the student unfit to drive,( can include the strong scent of cannabis) the pupil lesson for that day will be canceled and any lesson fee paid by the pupil will be forfeited.

Alloy wheels and Tyres

Alloy wheel scuffs are charged to the pupil should the pupil hit the kerb at any time during a driving test. The fee is charged at £50 per scuff irrespective of whether a scuff was on the wheel before. This doesn’t apply whilst on lessons.

Tyre replacement cost of 50% (eg, £100 tyre, pupil pays £50) value of the tyre will be levied to the pupil due to pupil puncturing the tyre if they were not concentrating or made a bad mistake whilst on the Driving Test. This does not apply on lessons.

The school operates a strict no Smoking in the vehicle policy.
