1. About these terms
These terms apply to driving lessons, driver training, instructor training and related services supplied by All Class Driving Academy (“ACDAL”, “we”, “us” or “our”). When you book or pay for a service, you agree to these terms. Any agreed variation should be confirmed in writing.
2. Eligibility and your driving licence
You must be legally entitled to drive the relevant vehicle and hold a valid UK provisional or full licence appropriate to the training. Learner tuition is normally available from age 17, or from age 16 where the learner qualifies under the applicable higher-rate mobility rules.
You must present your licence when requested and tell us promptly about any change that could affect your entitlement, insurance or fitness to drive.
3. Booking and lesson arrangements
Your booking is an agreement between you and the academy or the instructor delivering the lesson. Dates, times, meeting points, lesson length, vehicle type and price are confirmed when the booking is accepted. Standard learner lessons are normally two hours unless a different arrangement is agreed.
Please be ready at the agreed time and location. Time lost because a pupil is late normally forms part of the booked lesson and may not be replaced.
4. Payment
Unless another arrangement has been confirmed, lesson payment must be received no later than 48 hours before the session. Test-day lesson and car-hire fees must be paid at least seven days before the test. A booking may be released if payment is not received by the agreed deadline.
The price that applies is the price confirmed for your booking. Current public rates are shown on the Prices page; outdated promotional or draft prices do not apply.
5. Cancellations and changes by the pupil
Please give at least 48 hours’ notice if you need to cancel or change a lesson. Notice must allow two working days and does not count weekends or bank holidays as working days. A lesson cancelled too late, or missed without notice, is normally charged in full.
If you are ill, delayed or affected by an emergency, contact your instructor as soon as possible. Any waiver is at the academy’s reasonable discretion and is not guaranteed.
6. Cancellations by the academy
We may need to change or cancel a lesson because of instructor illness, unsafe weather, vehicle problems, traffic disruption or another event outside reasonable control. We will provide as much notice as reasonably possible and rearrange affected training.
Where the academy cancels a lesson with less than 48 hours’ notice for a reason within its control, the pupil will receive one additional hour of tuition without charge. This does not apply where the lesson could not safely or lawfully proceed because of the pupil’s condition, conduct, licence or vehicle-use eligibility.
7. Prepaid lessons and packages
Prepaid block-booking packages are personal to the named pupil, cannot be transferred and must normally be used within six months of purchase. Packages are sold at a discounted rate and are non-refundable except where consumer law requires otherwise or the academy agrees a refund in writing.
Where a pupil stops lessons and the unused credit held is equal to four hours or fewer, the pupil may request return of that unused balance. Any lesson falling within the late-cancellation period remains fully chargeable. Where a refund is legally due or expressly agreed, lessons already taken and any late-cancellation charges may be deducted at the standard pay-as-you-go rate before the balance is calculated. Payment processing or other unavoidable costs may also be deducted where lawful and made clear.
8. Your responsibilities during training
You must follow reasonable safety instructions, behave respectfully and make the instructor aware of anything that may affect safe tuition. Mobile phones must be switched off or silenced and must not be used while driving.
Wear secure footwear that supports safe pedal control and keeps the heel stable. Flip-flops, loose footwear or any footwear the instructor reasonably considers unsafe must not be worn. Bring any glasses or corrective lenses required for legal and safe driving, together with a notebook and pen if your instructor asks you to do so.
9. Alcohol, drugs and medication
You must not attend under the influence of alcohol, illegal drugs or any medicine that makes driving unsafe. Tell your instructor about medication or a condition that could affect alertness, judgement or control. If the instructor reasonably believes you are unfit—including where there is a strong smell of cannabis or alcohol—the lesson will not proceed and the fee will normally be forfeited.
10. Behaviour and respect
Abuse, threats, discrimination, harassment, deliberate damage or unsafe refusal to follow instructions will not be accepted. The instructor may end a lesson immediately where safety or welfare is at risk. Fees may remain payable and serious conduct may be reported to the appropriate authority.
Training is provided without unlawful discrimination. Please tell us about any reasonable adjustment or learning need as early as possible so it can be considered.
11. The instructor’s responsibilities
The instructor will use reasonable skill and care, tailor the lesson plan to the pupil, provide guidance and feedback, and maintain appropriate progress records. Tuition will normally be one-to-one unless a different arrangement is agreed.
Training vehicles will be maintained, insured for the agreed use and fitted with dual controls where appropriate. The instructor will explain significant changes to a lesson plan and provide honest guidance about test readiness.
12. Physical contact
An instructor may need to take immediate physical action in an emergency to protect people or property. Outside an emergency, consent will be sought before physical contact is used to demonstrate positioning or a driving technique.
13. Driving tests and use of the academy car
Use of an academy vehicle for a practical test is subject to availability, payment and the instructor being satisfied that the pupil can take the test safely and without creating unreasonable risk to the vehicle or others. The normal test-day service includes a one-hour pre-test lesson, tuition-car hire and insurance for the agreed test use, plus return to the original pickup point where this has been confirmed.
The academy may refuse use of its car if the pupil is not at an appropriate standard, has not followed the agreed preparation plan, is legally ineligible, or presents a safety or insurance concern. Where practicable, we aim to give at least three working days’ notice of a readiness-based refusal.
14. Test cancellations and delays
The DVSA controls practical tests and may cancel, delay or change a test. ACDAL is not responsible for DVSA decisions or other events outside our control. You are responsible for pursuing any reimbursement available from the DVSA and for additional tuition or vehicle time required because of a delayed or rescheduled test.
If our vehicle has a mechanical problem, we will make reasonable efforts to provide a suitable replacement or alternative arrangement. We are not responsible for loss that could not reasonably have been prevented.
15. Damage during a driving test
If, during a practical test, the pupil causes an alloy-wheel scuff through avoidable driving error, a charge of £50 may be made for each scuff. If a tyre is damaged during the test through the pupil’s avoidable error, the pupil may be charged 50% of the reasonable replacement cost.
These specific contributions apply to the practical test period, not ordinary lessons, and will not be charged where damage was caused by an existing defect or was not reasonably attributable to the pupil.
16. Smoking
Smoking and vaping are not permitted in academy vehicles.
17. Lesson time and service quality
If a lesson is shortened because of an academy error or a vehicle issue within our control, the missing tuition time will be added to a future session or otherwise reasonably resolved. This does not apply to time lost because the pupil is late, unfit, ineligible or chooses to end the lesson.
18. Photographs and learner success stories
We may invite a pupil to be photographed after an achievement. Identifiable photographs or named success stories will be published only where appropriate permission has been given. Permission is optional and can be withdrawn for future use by contacting us, although it may not be possible to recall material already printed or shared by others.
19. Ending tuition
You may stop tuition at any time, subject to the cancellation and prepaid-package terms above. We may decline or end tuition for non-payment, repeated cancellations, abuse, unsafe conduct, loss of driving entitlement, breakdown of the working relationship or another reasonable safety or business reason.
20. Complaints
Please raise a concern promptly with your instructor so there is an opportunity to resolve it. If it remains unresolved, email lennieadi@gmail.com with the booking date, a clear description of the issue and the outcome you are seeking. We will review the information and respond within a reasonable time.
21. Liability
Nothing in these terms limits liability where the law does not allow it, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Subject to that, we are not responsible for indirect or unforeseeable loss, loss caused by inaccurate information supplied by the pupil, or events outside reasonable control.
22. Law and changes
These terms are governed by the law of England and Wales, and the courts of England and Wales will have jurisdiction unless consumer law provides otherwise. We may update these terms for future bookings. The version in force when a booking is confirmed will apply to that booking unless a change is required by law or agreed with you.
